Terms and Conditions
Last updated: 26 October 2026
The short version
We grow gem squash and seed garlic on a small market garden on the Isle of Man. You order, we confirm, we pick or pack it, and you collect it or we send it. The price on the site is what you pay. Because it is fresh produce and living planting stock we cannot take it back once it has left us unless something is wrong with it — and if something is wrong with it, tell us and we will put it right.
1. Who you are buying from
Plot 48 is a trading name of Michael Wells, a sole trader. Your contract is with Michael Wells.
The premises are registered as a food business establishment under the Food Hygiene Regulations 2007, reference 24/00095/FOOD, trading from:
New Farmhouse,
Ballaquiggin Manor, Balnahowe,
Santon,
Isle of Man, IM4 1HW
Contact: admin@plot48.co.uk or 07624 278891.
In these terms, we and us means Plot 48, and you means the person placing the order.
2. How an order works
Adding items to your basket and paying is an offer to buy, not a completed contract. A contract exists once we send you an order confirmation by email. If we cannot fulfil your order — the crop has run out, or we cannot deliver to where you are — we will tell you and refund you in full.
We grow in small quantities and sell what the season gives us, so an item showing on the site is not a promise that it is in stock at that moment. Where we know something has run out we mark it sold out and it cannot be ordered.
3. Prices and payment
Prices are in pounds sterling and are shown on each product. We are not VAT registered, so no VAT is charged and the price you see is the price you pay.
Payment is taken when you order, through PayPal — which also handles card, Apple Pay and Google Pay payments. We never see or store your card details.
The price you pay is the one our system calculates at checkout, including delivery. If a price is shown incorrectly because of an error, we will contact you before taking payment and you may cancel.
4. Delivery and collection
| Option | Cost | Notes |
|---|---|---|
| Collection from the farm | Free | Message first so we know to expect you |
| Isle of Man delivery | £5.75 | Anywhere on the island; we agree a day |
| UK post | £3.75 or £5.75 | £3.75 for a 400g pack of garlic, £5.75 for anything else |
One delivery charge per order, however much you order, set by the dearest thing in it. Delivery is free on every order over £30.
We will give you an expected date, but because produce is picked and packed to order we cannot guarantee one. Delays caused by the postal service or a courier are outside our control, though they do not remove your rights under section 7.
Responsibility for the goods passes to you when you, or someone you have nominated, takes physical possession of them.
5. What you are buying
Gem squash is fresh produce. It keeps for weeks somewhere cool, dry and dark — a shed or a larder rather than the fridge. Weights are approximate: a kilo is a kilo as near as whole squash allow.
Elephant garlic is sold as planting stock, selected for growing on rather than for the kitchen. The planting figures on the box and on the site are our honest guidance from growing it here. How it does in your ground depends on your soil, your weather and what you do with it, and we cannot guarantee a crop.
If you have a question about either, ask before you order. We would rather answer a question than have you guess.
6. Cancellation and returns
Fresh produce and living planting stock are treated differently from other goods. The detail is on our returns and refunds page, which forms part of these terms. In short: you can cancel any time before we have sent your order, and if anything arrives damaged, rotten, late or not as described, we will replace it or refund it.
7. If something goes wrong
What we sell must be of satisfactory quality, fit for its purpose and as described. If it is not, you are entitled to a replacement or a refund. Nothing in these terms removes rights the law gives you.
Tell us as soon as you can at admin@plot48.co.uk, with your order number and — if the problem is the condition of the goods — a photograph. We aim to reply within two working days.
8. What we are responsible for
We are responsible for loss you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care. We are not responsible for loss that was not foreseeable, or for business losses — these terms cover sales to consumers.
We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not permit us to exclude. For a food business that matters: nothing here limits our liability for selling food that is unsafe.
9. Your information
We use your details to pick, pack and deliver your order, and for nothing else unless you have asked us to. Our privacy policy explains what we hold, why, and how to have it removed.
10. Changes to these terms
We may update these terms. The version that applies to your order is the one published when you placed it, and the date at the top tells you when this version took effect.
11. Law and complaints
These terms are governed by the law of the Isle of Man, and disputes may be brought in the Isle of Man courts. If you live in the United Kingdom, this does not take away rights you have under the consumer law that applies where you live.
If you are unhappy with how we have handled something, email admin@plot48.co.uk and we will do our best to sort it out directly.
